In this session, we will explore the intersection of these three often troubling and seemingly conflicting legal areas, including how these laws interact, the respective obligations of employers and employees, when the duty to accommodate and engage in the interactive process arises, avoiding the hire of and moving on from problematic and risky employees, proper documentation, and other strategies designed to ease the handling of these situations, reduce confusion and conflict, while also reducing risk.
